The Training Grounds Terms and Conditions - Trainers

These Trainer Terms and Conditions (“Trainer Terms”) apply to all trainers, coaches, and fitness professionals (“Trainers”) who offer services through The Training Grounds (“TTG”).

By listing availability, accepting bookings, or delivering sessions through TTG, you confirm that you have read, understood, and agree to these Trainer Terms.

1.0 The Training Grounds’ role

The Training Grounds operates a platform and marketplace that connects clients with independent Trainers. TTG provides booking, scheduling, payment, and support tools.

Unless expressly stated otherwise in writing, TTG:

  • Is not the training provider,

  • Is not a gym or medical service, and

  • Does not supervise day‑to‑day coaching delivery.

Each training session is a direct service relationship between you and the client, subject to these Trainer Terms and the End User Terms.

2.0 Trainer eligibility and accounts

You confirm that you:

  • Are legally permitted to provide training services in New Zealand,

  • Hold any required qualifications relevant to the services you offer,

  • Will keep your profile, availability, and contact information accurate and up to date.

You are responsible for all activity conducted under your Trainer account.

3.0 Bookings and scheduling

3.1.0 Accepting bookings

When you make time slots available and a client books:

  • The booking is considered confirmed once TTG issues confirmation and any required payment authorisation is successful.

  • You are expected to honour the booking exactly as scheduled.

3.2.0 Calendar accuracy

You must:

  • Maintain an accurate and up‑to‑date calendar,

  • Block out times when you are unavailable,

  • Avoid double‑booking or over‑committing.

Failure to manage availability appropriately may result in corrective action under these Terms.

4.0 Attendance and punctuality

4.1.0 Mandatory attendance

You are required to attend every confirmed session at the agreed time, date, and location (or online platform).

4.2.0 Punctuality

You must be:

  • Ready to coach at the scheduled start time, and

  • Appropriately prepared (equipment, plan, environment).

Late arrival without prior notice is considered a service failure.

4.3.0 No‑shows

A Trainer no‑show occurs if you:

  • Do not attend the session, or

  • Are not contactable within 10 minutes of the scheduled start time, without prior notice.

Trainer no‑shows are treated seriously and may result in reviews, penalties, or removal from the platform.

5.0 Coaching standards and quality

5.1.0 Best‑effort obligation

You are expected to provide your best professional coaching at every session. This includes:

  • Appropriate session planning,

  • Clear instruction and supervision,

  • Safe, client‑appropriate programming.

5.2.0 Duty of care

You must:

  • Prioritise client safety,

  • Modify sessions when required due to injury, fatigue, or ability level,

  • Stop or adjust a session if continuing would be unsafe.

5.3.0 Scope of practice

You must not provide medical, nutritional, or other regulated advice outside your qualifications. Clients must be referred to qualified professionals where appropriate.

6.0 Cancellations, availability changes, and refunds

6.1.0 Trainer‑initiated cancellations

If you become unavailable for a booked session, you must:

  • Notify the client as soon as reasonably possible, and

  • Notify TTG where required.

6.2.0 Client options

When a Trainer cancels, the client must be offered:

  • A rescheduled session at no additional cost, or

  • A full refund.

6.3.0 Refund responsibility

Where a Trainer cancellation or no‑show occurs, you agree that:

  • The client is entitled to a full refund, and

  • TTG may process the refund on your behalf and recover the amount from future payouts if applicable.

Repeated cancellations may lead to suspension or termination of your Trainer account.

7.0 Payments and fees

7.1.0 Pricing

Session prices are set by you and displayed on your TTG profile. Prices must be clear, accurate, and inclusive of applicable taxes unless otherwise stated.

7.2.0 Payment processing

Payments are processed via TTG’s third‑party payment providers. TTG may manage authorisations, captures, refunds, and payout timing in accordance with its platform processes.

7.3.0 Deductions

TTG may deduct:

  • Platform or service fees,

  • Approved refunds,

  • Chargebacks or failed payment amounts, from your payouts in line with these Terms.

8.0 Insurance and credentials

You must maintain, for the duration of your use of TTG:

  • Appropriate professional indemnity insurance,

  • Appropriate public liability insurance,

  • Valid certifications relevant to the services you provide.

Proof may be requested at any time. Failure to provide evidence may result in suspension.

9.0 Client conduct and boundaries

You must maintain professional boundaries with all clients. You must not:

  • Harass, discriminate, or behave inappropriately,

  • Train clients while impaired by drugs or alcohol,

  • Engage in misleading, deceptive, or unethical conduct.

Any behaviour that places clients or TTG at risk may result in immediate removal from the platform.

10.0 Health, safety, and risk

You are responsible for:

  • Ensuring the training environment is reasonably safe,

  • Checking equipment before use,

  • Following applicable health and safety laws.

You acknowledge that exercise involves inherent risk and agree to act reasonably and responsibly to reduce preventable harm.

11.0 Reviews, content, and platform use

Clients may leave reviews based on their genuine experience. You agree not to:

  • Attempt to manipulate reviews,

  • Pressure clients for positive feedback,

  • Retaliate against negative but fair reviews.

TTG may remove reviews that breach platform standards.

12.0 The Training Grounds’ limitations

TTG does not guarantee:

  • Your income, bookings, or client demand,

  • Continuous or uninterrupted platform access,

  • Outcomes or results from training services.

TTG is not responsible for losses caused by events outside its reasonable control.

13.0 Liability

To the maximum extent permitted by law:

  • You are responsible for your own coaching services and conduct,

  • TTG is not liable for indirect or consequential loss,

  • TTG’s total liability relating to a booking is limited to fees payable to TTG for that booking.

Nothing in these Terms limits rights under New Zealand consumer or employment laws that cannot be excluded.

14.0 Suspension and termination

TTG may suspend or terminate your Trainer account if you:

  • Repeatedly miss or cancel sessions,

  • Provide substandard or unsafe coaching,

  • Breach these Trainer Terms or the End User Terms,

  • Engage in fraud or misconduct.

Termination does not affect obligations relating to refunds, disputes, or outstanding fees.

15.0 Changes to these Terms

TTG may update these Trainer Terms from time to time. Continued use of the platform after changes take effect means you accept the updated Terms.

16.0 Governing law

These Trainer Terms are governed by the laws of New Zealand, and any disputes are subject to the jurisdiction of New Zealand courts.
